Your agreement with PAIGE WOODIE
Last modified: February 1, 2024
SECTION 1 – BOOKING TERMS AND RESERVATIONS
To participate in a tour, you must be over the age of 18, unless otherwise agreed upon by us. Upon booking, a 50% deposit of the trip’s cost is due to reserve your space on the experience. We reserve the right to decline any prospective participant and in that case, your deposit will be refunded in full. Final payment will be due 45 days prior to the start date of the booked experience. If full payment is not received by the agreed payment date, we reserve the right to cancel your reservation and retain your deposit.
SECTION 2 – INSURANCE
Travel insurance is mandatory and must have proof of insurance before joining an experience. It must cover the duration of the experience. Your insurance must cover personal injury, medical treatment, repatriation, and evacuation expenses. It is also recommended that the insurance cover personal property and trip cancellation. Please note that cancellation insurance is strongly encouraged as this may be the only means of receiving reimbursement for flights and other non-refundable expenses in the event the experience is canceled, postponed, interrupted, rescheduled, for any reason, by you or us. Most companies offering travel insurance require that the policy is to be purchased within 14 days of the trip’s initial deposit or payment in order to provide cancellation coverage. It is up to you, the traveler, to review, research, and purchase the cancellation insurance.
SECTION 3 – CANCELLATION
If you decide you need to cancel your experience for any reason, the following terms are outlined below. We must receive notice of your cancellation in writing to paige.woodie@gmail.com.
Unfortunately, your 50% deposit is non-refundable; however if you can find a replacement through your own network or if we are able to fill your cabin, a refund may be possible (this is not a guarantee and subject to our discretion). Our cancellation policy:
- From booking to 45 days prior to departure: 50% of the total trip cost is non-refundable
- 44-0 days prior to departure: 100% of the booking is non-refundable
If a flight or other delay for any reason prevents you from joining the experience on the experience’s start date, we are unable to provide a full or partial refund or credit. However, you may join late if you wish. Any costs that are accumulated in order to meet with the group/experience after the start date are at your own expense. Your decision not to travel due to pandemic, fear of travel, illness, or any other reason, will be deemed a cancellation (please refer to cancellation insurance in Section 2)
You are entitled to a full refund in the event that: (a) we cancel the experience; or (b) we reschedule the experience to a later date, and you do not wish to participate. The postponed experience will be subject to the terms and conditions of this agreement. We will not be liable for any other costs, damages, or refunds of any kind for any loss, delay, inconvenience, disappointment, or expense whatsoever.
SECTION 3 – SERVICE PROVIDERS
We serve as intermediaries for various travel service providers, including but not limited to, hotels, car rental companies, tour operators, charter companies, private car operators, and other entities mentioned in your itinerary or confirmation (“Service Providers”). Please note that we cannot be held accountable for the actions or negligence of these Service Providers, including their failure to adhere to their own schedules, deliver services or refunds, face financial difficulties, or honor future trip credits. We do not possess any privileged knowledge concerning the financial stability of the Service Providers, and we assume no liability for suggesting trip credits as an alternative to refunds. We retain the right to modify the itinerary of your experience in response to actions or omissions by the Service Providers or other circumstances beyond our control.
SECTION 4 – RISKS OF TRAVEL AND RELEASE
We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the Foreign Travel Advice website on the UK Govt. website, www.gov.uk/foreign-travel-advice. You can also use the UK Foreign Travel Advice page for advice about traveling abroad, including the latest information on coronavirus, safety and security, entry requirements and travel warnings. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THE TOUR OR PARTICIPATION IN ANY ACTIVITIES IN WHICH YOU PARTICIPATE.
SECTION 5 – Foreign Entry Rules:
You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.
SECTION 6 – BAGGAGE
We are not responsible for, and you are solely responsible for, securing or protecting your baggage and belongings at any time, during any Tour.
SECTION 7 – PHOTO AND IMAGE RELEASE
You acknowledge that if there is a Photographer on your booked experience, they will own the rights to the images, photos and videos that he or she takes. Images provided to you by us are for personal use and, when shared, you will provide credit to the creator and the experience you traveled on. This content is not to be used for any commercial purposes, at any time. You also understand and agree that you may appear in images, photos or videos that the photographer, guide and other travelers take. You grant both the photographer and Paige Woodie a worldwide, royalty-free and free of charge, perpetual license to use and/or distribute any images, photos or videos from your experience. This includes any images you share directly with us or on social media, whether through photo sharing or posting and related to any medium for any purpose.
SECTION 8 – PAYMENT METHODS
We are the merchant on your payment method of choice. Note that our services consist of facilitating the sale and paying the service providers. If a service provider does not provide the service or cancels the operations, your recourse is against the service provider, not us. You agree not to initiate a chargeback against us or a refund request that is not authorized by this agreement. You agree to also pay any and all legal fees incurred by us in disputing any claims for refund.
SECTION 9 – TRAVELERS NEEDING SPECIAL ASSISTANCE
We will make reasonable efforts to accommodate the needs of our travelers; however, travelers needing special assistance for their specific personal needs must notify us at the time of booking for a determination of what assistance we can reasonably provide. In cases where we cannot accommodate a traveler’s special needs, persons requiring this assistance must be accompanied by a companion who will be responsible for independently providing the needed assistance. We regret that we cannot provide special individual assistance to travelers with special needs for ordinary daily activities, such as walking, dining, etc. and other special needs. In no instance will we or our Service Providers physically lift or assist participants on to or off transportation vehicles.
SECTION 10 – TOUR BEHAVIOR
You are also responsible for respecting the authority and laws of the countries in your itinerary, including local health and safety regulations, and following the directions of the tour guide. We may exclude you from participating in all or any part of the tour if, in our sole discretion, your condition or behavior renders you unfit for the tour or unfit for continuation once the tour has begun. Unfitness may include, without limitation, use of illegal drugs, persistent inebriation, or any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of tour services, or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to refund of the recoverable cost of any unused portion of the tour. Should you decide not to participate in certain parts of the tour, no refunds will be made for those unused parts of the tour.
SECTION 11 – MEDICAL PROXY
If you are unable to authorize your own medical attention and treatment, you authorize us or our subcontractors or agents to authorize medical attention and treatment on your behalf. You agree to hold harmless and release us or them from any liability for medical attention authorized by us or them on your behalf. We assume no liability regarding provision of medical care or evacuation services. Any of our staff or subcontractors who may provide or seek emergency medical care on your behalf may not have had formal medical or first aid training and are acting only as a Good Samaritan.
SECTION 12 – CLAIMS DEADLINE AND EXCLUSIVE JURISDICTION
You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in the United Kingdom will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.
